Legal Profession

1. Lawyer is a general term for a person who is qualified to advise people about the law, to prepare legal documents for them or to represent them in a court of law. Working as a lawyer involves the practical application of abstract legal theories and knowledge to solve specific individualized problems of those who ask lawyers to perform legal services.

2. A lawyer often has several functions: investigator, drafter, negotiator, advisor, and advocate. As a professional the lawyer is usually permitted to carry out the following responsibilities:

- oral argument in the courts;

- research and drafting of court papers;

- legal adviceas the application of legal theory to the concrete facts of the client's case in order to advise the client about what they should do next;

- negotiating and drafting contracts;

- carrying outthe intent of the deceased;

- prosecution and defense of criminal suspects;

- performance of judicial functions.

3. In each country either the judiciary, or the Ministry of Justice, or a professional association directly supervises the admission, licensing, and regulation of lawyers.

4. For example in England there are two different kinds of lawyers, with separate jobs in the legal system: solicitors and barristers. They are regulated by two different professional bodies: the Law Society and the Inns of Court. Practicing solicitors counsel clients on matters both civil and criminal. In cases of unusual difficulty only barristers may represent the client at the trial, because they have rights of audience in the higher courts.

5. In order to practice law in the USA, one must first be "admitted to the bar" in an individual state. This entails passing the state bar exam. Generally, state bar examiners require evidence of four qualities in exam candidates: sufficient general education at the undergraduate level; sufficient US legal education; sufficient knowledge of local bar requirements; and an applicant’s character and his fitness to engage in the practice of law.

6. Lawyers are paid for their work in a variety of ways. Lawyers working directly on the payroll of governments and corporations usually earn a regular annual salary. In private practice, they may work for an hourly fee or a contingency fee. In many countries there are fee-shifting arrangements by which the loser must pay the winner's fees and costs.
